How is Paternity Established?
If the mother is married when the child is born, her husband will be legally presumed to be the child’s father. If the mother marries the biological father after the child is born, they will become the legal father through legitimization. When paternity is not disputed for unmarried couples, a Voluntary Acknowledgement of Paternity form can be filled out to establish the legal father.
When paternity is disputed by either the father or mother, however, things can get a bit more complex. Parties wishing to establish the paternity of a child will need to file a paternity action with the court. These actions can be brought by the parents, but the Florida Department of Revenue may order a genetic test for the purposes of child support.
