Two Different Types of Guardianships in Miami, FL
There are two different types of guardianships: one for an adult that becomes incapacitated or disabled and one for a minor child whose parents are unable or unwilling to take care of them.
- Minor Child: When the parent(s) of a minor child pass away or become financially or physically unable to take care of them, a guardianship is needed. Oftentimes, the guardian will be held responsible for making both financial and personal decisions for the child. These decisions can range anywhere from their daily meals to where they will live and what school they will attend.
- Incapacitated or Disabled Individual: When an adult becomes disabled or incapacitated and is unable to make important decisions, a guardian is then appointed to step in. A guardianship is only appropriate during circumstances in which other less restrictive alternatives are not set in place such as a health care surrogate, durable power of attorney, trust or any other type of health care directive.
Both types of guardianships are established so that the individuals get the proper care they need and so that someone can step in and make the necessary and appropriate decisions for them.
